Australia Post fails to secure digital injunction

Australia Post's application for an interlocutory injunction to stop Digital Post Australia using that name until its legal case against the company is heard has failed.

The case will now proceed to trial in the Federal Court next month where the Court will decide whether Digital Post Australia was likely to mislead or deceive consumers, and breach the Competition and Consumer Act.

Both organisations are racing to roll out digital postbox services, which will allow people to collect and store documents such as bills and invoices online. Digital Post Australia, which is a joint venture between Computershare, Salmat and Zumbox announced its plans 11 days before Australia Post revealed its intent.

Digital Post chairman David Hynes said he was delighted with the outcome which allows the company to continue to use the name at least until the case is heard.
