Jurors in the case filed by Oracle against Google have still not reached a verdict and indications yesterday were that a unanimous decision was proving hard to reach.
According to the
Economic Times, Judge William Alsup spoke to the jury after one juror asked him what they should do if they could not reach a unanimous verdict and nobody was willing to change their stance.
If this eventuates, then the judge has indicated that his preference is to move to the next phase of the trial, the patents phase, and leave the first phase to be decided later.
if the jury is deadlocked, then the two lawyers in the case have been asked to propose ways forward.
In another development, Justice Alsup asked Google to provide accounts of Android profit and loss so that jurors could understand exactly how much the company was making from the mobile operating system.
Oracle has accused Google of violating patents and copyrights pertaining to 37 Java application programming interfaces. Google says APIs are not copyrightable and that whatever it used is permissible under the principle of fair use.
