MobileActive subsidiaries hit with $375k penalty for misleading TV ads

The Federal Court has imposed penalties totalling $375,000 on two subsidiaries of MobileActive (ASX: MBA) for making false or misleading representations in their TV advertisements for mobile premium services.

The Federal Court has ordered Global One Mobile Entertainment Pty Ltd to pay a penalty of $150,00 and 6G Pty Ltd a penalty of $225,000.  MobileActive said that the two companies were "presently considering their position in relation to a possible appeal."

In October 2010 the ACCC instituted proceedings in the Federal Court in Sydney against the two companies for advertisements promoting a number of mobile phone ringtones including "One Time" by Justin Bieber; entry to a quiz with a prize of $100,000; a mobile phone game called Space Invaders, and a mobile phone game called Doodle Jump.

The ACCC alleged that that consumers had been mislead into believing they could buy the service at a one-off cost when in fact they were requesting access to a subscription service.
