The
Smoking Everywhere website describes its E-cigarette as:
“It Looks like a cigarette, Feels like a cigarette, Taste like a cigarette, But it is not a cigarette. It is just so much more....”
The
Njoy website states, “
NJOY looks, feels and tastes like a cigarette or cigar. What makes it better is the freedom to smoke anywhere, anytime, no second hand smoke and lower cost.”
Therefore, the FDA considers the Smoking Everywhere and the Njoy E-cigarettes to be illegal.
The WebMD article quotes Michael Levy, the director of the FDA’s Office of Compliance (Division of Drug Evaluation and Research). Levy states,
“The products we reviewed so far we found to be illegal."
He said they have not been outright banned by the FDA because, "
There is pending litigation on the issue of FDA's jurisdiction over e-cigarettes,"
However, the FDA has taken a position on its view of E-cigarettes.
Joshua Sharfstein, the principal deputy commissioner at the FDA, states,
“We felt it important that while there is litigation and we are considering options, there is no reason to be confused about FDA's position on this issue,"
The FDA position is: based on the two brands tested, it considers E-cigarettes to be illegal.
