Apple's Mighty Mouse may need new identity

Opinion and Analysis

It would be hard to argue that, for example, any use of the phrase Mickey Mouse is possible without being a reference to the Disney character.

However, the Mighty Mouse name is used by other organisations, including Glenair (for a family of electrical connectors) and Northwestern University (for a mutant line of rodents), and this may be to Men & Machines' advantage.

Man & Machine's Mighty Mouse is silicone sealed to make it waterproof and chemical resistant. The USB device (a PS/2 adaptor is available) is aimed at medical, industrial and marine applications.

The company's brief press release says "Man & Machine, Inc. declines to discuss its trademark-infringement complaint against Apple, Inc. and CBS Corporation, the underlying merits of the case, or any related settlement discussions, since the litigation remains pending.

"In the meantime, we remain committed to protecting our rights to the MIGHTY MOUSE trademark and also to finding a fair resolution for all involved parties."

Apple is no stranger to trademark issues. A dispute with The Beatles' company Apple Corps ran for years before a final resolution was reached, the attempt to trademark Macintosh was originally knocked back because McIntosh was already registered by audio equipment manufacturer McIntosh Labs, Apple's iPhone was announced before it had secured rights to the name from trademark owner Cisco, and Rendezvous was renamed Bonjour after a clash with Tibco.
