TPG's 'unlimited' ADSL exceeds the limits of ACCC's tolerance

The ACCC has come down hard on yet another 'unlimited' communications offer, this time TPG's $29.95 per month 'unlimited' ADSL.

The ACCC has instituted legal proceedings against the company in the Federal Court in Melbourne, alleging contraventions of the Trade Practices Act.

What has upset the ACCC this time is not hidden limits in the so-called 'unlimited' plan, as has often been the case in the ACCC's actions, it is the fact that TPG, allegedly, did not adequately disclose that the $29.95 unlimited ADSL offer was available only in conjunction with a $30 per month phone line rental, and that there were $149.95 percent of upfront charges: a $129.95 broadband setup fee and a $20 home telephone deposit.

The ACCC is seeking declarations that TPG contravened the Act, injunctions (including interlocutory injunctions), pecuniary penalties, corrective advertising and costs. The matter has been filed in the Federal Court's Fast Track list, and is listed for an interlocutory hearing at 10.15 a.m. on 22 December 2010 before Justice Ryan.
