ACMA forced to review ban on Sunday research calls

The ACMA has been forced to review its prohibition on market research calls on Sundays after an un-named party made a direct appeal to the minister.

The prohibition was contained in the ACMA standard for telemarketing and research calls, issued in March. It is due to come into operation on 31 May at the same time as the do not call register starts operation.

The ACCC consulted widely with industry to develop the standard: it issued a discussion paper seeking comments in August 2006 and when it launched the standard, chairman Chris Chapman said the ACMA had "sought to balance consumer and industry expectations and needs in relation to the making of telemarketing and research calls."

However despite this and with the standard now finalised and about to come into effect, the ACMA has announced that it has been directed by the minister, Helen Coonan, to review its ban on Sunday research calling. It says the direction follows "representations made directly to [Coonan]." The minister's direction requires ACMA to "consider certain matters including the public benefit derived from accurate and high-quality research."

The ACMA has now issued a new discussion paper: "Consideration of whether to remove the prohibition on making Research Calls on Sundays". It is asking anyone advocatin the removal of prohibition on Sunday research calls to identify the likely impact that the prohibition would have on the collection of accurate and high quality research, to provide information on the other impacts to businesses and outline the public benefit that would be derived allowing research calls to be made on Sundays.
