AMD must wait until 2009 for Intel antitrust trial

A US federal judge has set a date more than two and half years away for an antitrust trial chipmaker AMD has initiated against its larger Silicon Valley neighbour Intel.

Yesterday Judge Joseph Farnan dealt a blow to the case of AMD by ruling that most of its claims were outside the jurisdiction of US courts as they related to alleged incidents that took place in Europe and Asia.

AMD contends that Intel built its dominant position in processors at AMD's expense by pressuring major customers not to buy AMD. However, as the AMD processors in question were not made or assembled in the US, the judge sided with Intel that its behaviour on foreign soil had no consequences for the US market.

However, AMD will get to have second crack at Intel, with Judge Farnan ruling that AMD can commence a trial in which it can attempt to prove that Intel's activities abroad affected the US market.

The trial commences on April 27 2009 and Intel is pressing hard to use yesterday's ruling to prevent AMD from using discovery outside the US to build its case.
