The Government has offered Australia's three mobile operators, and vividwireless, renewal of their existing spectrum allocated on 15 year licences in the late 90s and early 2000s at set prices, while the Government expects to rake in $3 billion.
The ACCC's long running legal battle against mobile phone reseller Allphones over alleged illegal treatment of its franchisees has escalated with the ACCC alleging that Allphones has breached court orders on earlier undertaking given to the court and covering its treatment of its franchisees.
The orders were made by Justice Foster in the Federal Court on October 9 2008. The two that Allphones is alleged to have breached prohibit Allphones from withholding consent to the assignment of an Allphones franchise on the basis that the franchisee will not sign a deed releasing Allphones from liability and require Allphones to give the ACCC seven days written notice of its intention to withhold consent to the assignment of an Allphones franchise on the basis that the new franchisee must enter into a new franchise agreement.
The ACCC alleges that Allphones breached the first of these on one occasion and the second on three occasions. A directions hearing has been set down in the Federal Court in Sydney for August 21.
This latest action by the ACCC follows it initiating a class action against Allphones earlier this week on behalf of 74 current and former Allphones franchisees in relation to the alleged offences that were the subject of the ACCC's initial court action against the company, started early last year.
