AFACT has
issued the press a short statement including a Word .doc transcript
“from today’s directions hearing on the iinet case regarding internet
piracy of films and TV shows today.”
Earlier today Australian ISP iiNet issued a statement noting that “iiNet begins its defence in the Federal Court today against a selection of film and television industry organisations alleging that iiNet authorised customers to download films in breach of copyright laws.
“iiNet will vigorously defend the Federal Court action and denies that it authorised such activity.”
AFACT, the Australian Federation Against Copyright Theft, has issued a brief statement to the press containing a 7 page Word .doc transcript of the proceedings, along with a Word .doc court order outlining that will happen next.
AFACT’s emailed statement is as follows:
"Please find attached the transcript from today’s directions hearing on the iinet case regarding internet piracy of films and TV shows today.
“You will note that Justice Cowdroy was keen to understand whether there is any dispute that the films referred to in the statement of claim were made available on the internet.
“Despite claims by iinet that they have begun their defence in earnest today, they were not able to answer his Honour’s repeated requests to answer his question.
“You will also note that iinet must file their defence by 5 February 2009.”
The “APPLICANTS’ SHORT MINUTES OF ORDER” attached document says:
"THE COURT ORDERS THAT:
1 Evidence in the proceedings be by way of affidavit.
2 The respondent file and serve its defence by 5 February 2009.
3 The matter be listed for further directions at 9:30am on 6 February 2009.
4 There be liberty to apply on 2 days’ notice.
THE COURT NOTES THAT:
5 The applicants have indicated that they will reply to the request for particulars contained in the letter from Herbert Geer dated 15 December 2008, before 16 January 2009."
