The Government has offered Australia's three mobile operators, and vividwireless, renewal of their existing spectrum allocated on 15 year licences in the late 90s and early 2000s at set prices, while the Government expects to rake in $3 billion.
The ACCC has secured a court enforceable undertaking from TPG over its claims of "unlimited" calls and text messages under its "Unlimited Cap Saver" mobile phone plan advertised on television, in newspapers and on billboards. In late 2008.
The ACCC contends TPG represented that the plan included unlimited calls and text for $59.99 per month when, in fact, there were multiple exclusions. Calls to 1800, 13 and 1300 numbers, directory assistance, international calls and SMS, calls to Mobilesat, premium SMS, and calls to operator assistance were not included. Furthermore, TPG neglected to mention that there was an additional $20 SIM registration charge added on to the first month's cost.
TPG has undertaken that it will not, for three years, publish an advertisement for a mobile plan which states that for a specified price there will be unlimited calls and text when certain calls and text are excluded or additional charges will apply, without including an appropriately prominent disclaimer to the effect that exceptions, terms and conditions apply.
It has also agreed to publish a corrective notice on its website and to implement a trade practices law compliance program under which all relevant staff and management will take part in training.
