Telstra drops Next G appeal

IT Industry - Market

Telstra has withdrawn its appeal against the Federal Court's December 2007 ruling that it engaged in false, misleading or deceptive conduct in relation to the coverage available on its Next G mobile network, according to the Australian Competition and Consumer Commission.

ACCC chairman Graeme Samuel said "Telstra's decision to discontinue its appeal proceedings brings a welcome end to this matter, and vindicates the ACCC's strong intervention to protect consumers from misleading marketing in the telecommunications industry."

Telstra is now faced with paying the ACCC's costs in relation to the appeal and the original proceedings.

Action brought by the ACCC against Telstra resulted in Federal Court injunctions in December 2007 that restrained Telstra from making certain representations about the coverage provided by its Next G 3G mobile network without explaining that coverage depends on the user's location, the handset, and whether an external antenna is attached.

Telstra has been complying with this requirement by displaying notices to that effect at points of sale.
