The dispute, as the whole world now knows is about Apple Computer using its trademark in connection with its online music store iTunes. An agreement reached between the two companies in 1991 stipulated that Apple Computer would not its trademark in connection with the music industry. However, Apple Computer contended that the agreement did not cover online music and digital downloads, which did not exist when the the agreement was struck. If Apple Corps wins the appeal, Apple Computer will be up for significant damages plus legal costs. {moscomment} |
