Media Q&A with Conroy over Telstra NBN exclusion E-mail

QUESTION: Before we leave, I just want to be crystal clear, it wasn't [indistinct] answered to David earlier. Has the Government ruled out dealing with Telstra, negotiating with Telstra, after the RFP process has been completed.

STEPHEN CONROY: The RFP process will come forward with a recommendation, and I'm not in a position to second-guess what that recommendation will be. Telstra are excluded…

QUESTION: [Indistinct] Telstra though. Can you…

STEPHEN CONROY: Telstra are excluded from the RFP . I don't think I can be clearer than that. They've acknowledged it today, they've accepted it today. So I'm not going to be in a situation where I'm second guessing.

QUESTION: [Indistinct] negotiating with Telstra after that's finished?

STEPHEN CONROY: What I'm saying is I'm not going to be in a situation where I'm going to second guess the recommendations of the expert panel. They could come forward and say, look, here's three alternate outcomes. Here's one alternate outcome. So I'm just not going to second guess them, because that would be unfair.

QUESTION: … recommendations can include Telstra, they're excluded from that. So they could recommend none or they could recommend all or only one. Have you excluded negotiating with Telstra.

STEPHEN CONROY: That's exactly why I won't speculate on the outcome, because as you say, look, it could include a whole range of things, so I'm not going to pre-empt the position that the expert panel may come forward with…

QUESTION: Does that mean that they could come back and say well none of these bids are actually going to deliver what we wanted, then you'd be forced back to the table with Telstra.

STEPHEN CONROY: Well yeah. We can have a chat about all the potential hypotheticals that might happen. And I'm just not going to speculate at this point.

QUESTION: With the timetable for the winning bidder being announced [indistinct], is it still…

STEPHEN CONROY: Our ambition has been to try and sign a contract by the end of March. We'll get the recommendation towards the end of January, and then depending on what the recommendation is, is where it comes to your point and Dennises, and - point about whether or not the recommendation is one thing or another thing, so at this stage, that's certainly our ambition.

QUESTION: When will you make the panel's recommendations public.

STEPHEN CONROY: Look, depending on what the recommendations are, I said, I'll give that consideration. I haven't said that I would. It will depend on what those recommendations were. So I'll take that on advisement from legal advisers, and there could be legal issues with all sorts of threats of legal action over us, and it may be that we just have to keep it under wraps.

But it will depend largely on what the recommendations are.
