Apple heading for court in another iPhone 3G potential class action E-mail

Apple's facing another iPhone 3G lawsuit - and this time AT&T been brought into the case as well. But is this the way such issues should be handled?

Another lawsuit has been brought against Apple, this time on its home turf of California,  alleging that the iPhone 3G has been oversold in terms of it failing to deliver the claimed performance and in larger numbers than AT&T's network can support. AT&T is a co-defendant in the action.

An earlier case against Apple alleging false advertising of the iPhone 3G's performance was recently filed by a woman in Alabama.

The plaintiffs in both cases are seeking class action status.

The whole question of iPhone 3G performance is a mystery still waiting to be solved. Some users report excellent performance, others the opposite. The cellular networks do appear to be implicated, as an international survey found significant differences in data throughput among various networks around the world.

Yet the experiences of different customers of a single carrier can vary dramatically, and some people have reported poor or non-existent 3G reception in locations where other 3G devices work fine.

Returning to the matter of the court cases, part of the problem is that old-style mindsets don't always translate well to the modern world. If you buy a kilo of flour, it's pretty clear that you should get a kilo of flour.
