Page 4 of the eBay rebels’ latest letter continues below:

”This list is of all comments in the past 4 weeks only, and containing the word PayPal :

• oh, and don't expect help from eBay or paypal,found in my favor,no money coming!
• all keep on to eBay & paypal to do something about it plenty have been burnt
• NO ITEM,NO REFUND THRU PAYPAL,SEE U ALL IN COURT
• Well eBay & Paypal your even worse than that XXXXhead
• Yep add me to never ending list. Long wait for no bike. Paypal better cough up!
• Item not received. Unable to get answers from seller. Dispute raised with Paypal
• No delivery or contact. Claim raised with Paypal.
• This seller is a theif and Paypal better come good or on the new i go.
• No goods; no communication. Will file item dispute and chase up with Paypal
• recieved refund from paypal ,did not recieve item like the rest of you

“Our group is expecting a reply from the RBA this week, and formal replies from Ministers et al should start to arrive through the system shortly.

“Our group is committed to forcing eBay and PayPal to comply with the consumer laws of our country and we will not rest until the job is done.”

Here the letter ends.

Interesting comments have already appeared at eBay's Forums concerning this issue.

Three interesting comments are as follows, with the first and second comments to be found in this thread:

1. "eBay are attempting to deflect criticism or responsibility by putting the onus onto its subsidiary PayPal. The implication they are attempting to convey is that PayPal will still cover those who paid by PayPal, even though the Buyer Protection Policy doesn't apply to many of those who paid by PayPal. This is deliberate coat-trailing, an attempt to mislead media and customers and others.

"The responsibility is eBay's. If a special fund is set up to protect buyers, it's eBay's responsibility, not PayPal's. PayPal's would be covering those who fall under Buyer Protection Policy.

"Do not let eBay get away with this shoddy behaviour."

2. "eBay set a similar precedent of liability admission when they set up a compo fund for the 4000 holiday scam victims to keep it out of court. They paid by all different methods, so I can't see how transaction method can be held to be causal in these ongoing scams originating from eBay specifically.

"If this current issue were taken to court, I would bet that causality would be traced back to eBay's 'anyone can join' membership practices. If a legal ruling was entered into public record against eBay for this, it would open the floodgate to compensation claims for all other consumers ripped off by unverified sellers. This is why EBAY fiercely avoid any suggestion that the fraud is originating from their failure to verify sellers, whilst to most of us, it seems pretty obvious.

"SELLER VERIFICATION is the most efficient way to sort the chaff from the grain, and yet, STILL, EBAY ignore any intelligent suggestions for mitigating this consumer blood fest unless they can turn a profit from it.

"Ebay have managed to translate their moral and legal responsibilities to provide a 'safe' marketplace, into a marketable commodity, that does nothing to curtail the cause of consumer rip offs. For that matter, it does nothing to compensate those being ripped off presently. So exactly what is PayPal good for?

"Ebay are well aware that fraud flourishes on this site due to their lack of constraints or safeguards and yet they do nothing. If this went to court, I can assure you that this refusal to mitigate would become focal.

"Verification of Sellers in particular, may not be the 'be all end all', but it's a damn good start."

3. "It's also an open admission of liability since the buyers aren't actually covered under Paypals' 'take no liability for anything' User Agreement. They are only offering this up front to stay out of court. No legal case for damages exists whilst Paypal has it's hand in the air offering compo. It's strategic so they can avoid any legal ruling being entered into record against them. Ebay hate those legal precedents. Ouch.

"Ebay set a similar precedent when it set up a $1 Million compo fund for the holiday scam victims. It was an open admission of liability in anyone's language.

"The compo fund was clearly an 'out of court' settlement, to avoid actually being hauled into court. Causality is a major focus for any case like this, and of course, they would have been found responsible for the holiday scam, due to a complete lack of due diligence in verifying sellers. The fraud is coming from Ebay, growing on ebay and being nourished by Ebay's total lack of constraints.

"Fraud happens because anyone can join and sell on Ebay. Half of QLD's fraud reports for 2007 all originated from 23 repeat offenders who simply opened new accounts on ebay, and off they went again.

"Generalising this to the whole of Australia, this type of consumer fraud, might actually account for more than half of all reported fraud complaints Nationally. Not a small issue by any means."
