Reason? The SCO Group has declared that it will be filing for Chapter 11 bankruptcy. Yes, this is the same group that was so confidently asserting that it would appeal against a recent judgement that rules Novell was the owner of the Unix IP which SCO claimed to own. The news comes just a few days before the beginning of a court case to establish exactly how much SCO owed Novell as a result of last month's ruling on Unix IP. This means that the case will not appear in court as US law dictates that it cannot proceed when Chapter 11 proceedings begin. Darl Mcbride. the chief executive of the company, was quoted in a press release as saying: "We want to assure our customers and partners that they can continue to rely on SCO products, support and services for their business critical operations. Chapter 11 reorganization (sic) provides the Company with an opportunity to protect its assets during this time while focusing on building our future plans." That future is not looking overly bright now, methinks. And it is fair to assume that none of the cheerleaders of the SCO Group will be coming forward to push their tortured opinions in the media. IBM's reaction is characteristic of its low-key approach; the company has said nothing. IBM, remember, was the first to be sued by the SCO group way back in March 2003. Then the cases came thick and fast and so did the counter-cases. Now the chief protagonist has gone belly up. While SCO's reported assets are in excess of its liabilities, the company has yet to factor in court costs. And no doubt, there will be damages sought by Novell - though how you can get damages from a carcass beats me. It looks like I won't be getting an interview with Laura DiDio even though I wrote and asked for one. She seems to have gone underground. |
