We're not sure how far he'll get with that one, because the exclusive arrangement between Apple and AT&T was widely reported. But if there isn't a warning about this on the box or at the point of sale, who knows what the New York state Supreme Court will decide. Apple's web site currently reads "Can I 'unlock' iPhone and use it with another wireless carrier? AT&T is the exclusive wireless carrier for iPhone in the United States." The addition of the word "No" at the beginning of the answer would remove any ambiguity, but as it stands, the statement reminds us of taglines such as "the official beer of the Gumball Sports League." Nobody assumes that Gumballers drink only that beer, just that the brewer has paid a lot of money to be associated with the league. But we're more optimistic for Kliegerman when it comes to his claim about excess charges when the iPhone is used overseas. Apple's web site does say "Every AT&T service plan for iPhone comes with unlimited data for web browsing and email" and "You can browse the Internet and send emails as often as you like without being charged extra." Kleigerman reportedly says he was billed $US2000 for email and Internet use after spending a week in Mexico, and that while AT&T will provide unlock codes for other handsets, it will not do the same for iPhones. The suit seeks a prohibition on the sale of carrier-locked iPhones, the release of unlocking codes to existing owners, and disclosure of the charges applying when the phone is used outside the US. |
